General Terms and Conditions of Spildooren Ballooning

Article 1. SCOPE
1.1 These general terms and conditions apply to all quotations and agreements of Spildooren Ballooning, even if conflicting provisions appear in the client’s documents. By placing an order, the client accepts these general terms and conditions of Spildooren Ballooning.

The terms apply to passengers flying with Spildooren Ballooning as the operator. They cover the transport of passengers and their baggage as well as the delivery of services performed by Spildooren Ballooning for a fee.

Spildooren Ballooning may, in specific cases, waive one or more of these provisions. This can be requested by email via info@spildooren-ballooning.be

1.2 If the client also refers to their own terms and conditions when entering into the agreement, these current terms prevail. All transportation is subject to the general and pricing conditions in effect on the day the balloon ride is booked, a gift voucher is issued, or — if that date is unknown — on the day the transport begins.
ARTICLE 2. GIFT VOUCHERS
2.1 A gift voucher is only issued upon payment of the applicable fee and is valid only after payment. Use of the gift voucher is only valid upon presentation of a valid voucher. There is no right to transportation if the voucher has been altered without authorization from Spildooren Ballooning.
2.2 Each voucher contains a unique serial number. If Spildooren Ballooning detects an irregular, non-issued, expired, or previously used serial number, the voucher becomes void.
2.3 Purchased gift vouchers are valid for 1 year from the date of issue. The voucher can be extended once for an additional year. During the final month before expiration, the customer must inform Spildooren Ballooning of their wish to extend via email to info@spildooren-ballooning.be. The authorized representative will confirm the extension and specify the new expiry date.
2.4 Voucher Submission: Gift vouchers must be handed over to the pilot or other authorized representative of Spildooren Ballooning prior to the flight.
ARTICLE 3. RATES AND FEES
3.1 Rates apply solely to air transport from the departure to the landing location.
3.2 Published rates include VAT, unless otherwise stated.
3.3 All rates are quoted in Euro. All payments must be made in Euro.
ARTICLE 4. PAYMENT
4.1 Payment for the balloon ride is made in advance, unless otherwise agreed.
4.2 If post-payment is agreed, it must be completed within 30 days of the invoice date.
4.3 Spildooren Ballooning reserves the right to unilaterally terminate the agreement without legal intervention in case of non-payment or late payment.
4.4 Transport or other services are invoiced as specified in the agreement. Payment must be made within 30 days. For full or partial non-payment due to negligence or unjustified reason, the outstanding amount is legally and automatically increased by 12% with a minimum of €100, from the date of demand until full settlement. Spildooren Ballooning also reserves the right to suspend further commitments until full payment is received.
4.5 Invoices are payable via bank transfer to the account of Spildooren Ballooning. In case of dispute, the courts of Dendermonde have jurisdiction.

Article 5 Cancellation of services

The customer may cancel as long as Spildooren Ballooning has not started work, subject to a cancellation fee of 50% of the agreed price.

Article 6 Delivery

As ballooning depends heavily on weather conditions, no rights can be derived from late delivery of services. Scheduled dates are indicative and non-binding. Delays do not entitle the customer to compensation, price reduction, or cancellation.

ARTICLE 7. Termination of Agreement

7.1 If the customer commits a serious contractual breach and fails to rectify it within 10 days of receiving a registered notice, Spildooren Ballooning may suspend the agreement or terminate it immediately. Failure to pay one or more invoices is considered a serious contractual breach.

 

Article 7.2 Upon termination, the client shall pay for all services rendered, additional costs, and a lump sum compensation of 25% of the remaining invoiceable amount. Any advance payment remains acquired by Spildooren Ballooning. Higher compensation may be claimed if actual damages exceed the lump sum.

 

7.3 Both parties agree to first seek an amicable resolution and grant reasonable time to remedy any breach.

ARTICLE 8. CHECK-IN FOR FLIGHT
Passengers must check in at the designated location by the stated deadline. Late arrival or failure to present the required voucher may result in cancellation without delay of the flight. Spildooren Ballooning is not liable for loss or costs resulting from this.
ARTICLE 9. REFUSAL AND LIMITATION OF TRANSPORT
Right to Refuse Transport. Spildooren Ballooning or its pilot may refuse or discontinue transport for safety reasons or at their reasonable discretion.
9.1.1 if the passenger’s behavior, age, or physical/mental condition reasonably appears to require special assistance that cannot be provided, causes discomfort or danger, or poses risk to themselves or others.
9.1.2 if the passenger fails to follow reasonable instructions needed for safe and comfortable travel.
9.1.3 if applicable fees or surcharges are unpaid or payment agreements are not honored.
9.1.4 if the passenger’s voucher:
9.1.4.1 appears invalid,
9.1.4.2 appears to be illegally obtained,
9.1.4.3 is reported as lost/stolen, fraudulent, or suspicious,
9.1.4.4 appears to be forged.
ARTICLE 10. CONDUCT ON BOARD
10.1 Smoking on board is prohibited.
10.2 Passengers must follow all instructions from the pilot and crew regarding the operation of the flight — before, during, and after the balloon ride.
ARTICLE 11. APPLICABLE LAW
11.1 The validity, interpretation, and execution of the agreement between Spildooren Ballooning and the client shall be governed by Belgian law.
